LEGISLATIVE STATUS 2008-02-17

The array of bills coming down the pike is listed below, with hearing dates as given. House bills (those with HB number) are in the queue at House Judiciary Committee, and Senate bills (SB) are queued at the Senate Judicial Proceedings Committee. Generally the goal is to get grassroots noise into committee members' offices on the day of a given bill's hearing and for the couple days following. (Calls or letters arriving too early are largely ignored as not terribly relevant in offices dealing with a few hundred issues at a time. If the bill isn't ripe for a hearing or vote, staff won't bother the legislator with messages about it. Also, concentrated feedback, when the time is ripe, gets us far more attention than the same number of calls spread over weeks. Important: Personalize all contacts . Computers make it easy for you to send mass email to committees – computers make it just as efficient to ignore form letters. Staff are less likely to risk ditching a note if it is personal to their boss. Keep it short, polite and to the point.) The MDRKBA email alerts let you know when and where. If you haven't signed up yet, do so today!

HB 640

Family Law - Temporary Protective Orders - Surrender of Firearms Allows a judge to order someone's guns confiscated “ex parte”, without having a day in court. (Also filed under SB 42)

HB 659

Temporary Protective Order - Additional Relief Partially duplicates federal law then extends it to allow a judge to order guns to be confiscated “ex parte”. (This is a variation on HB 640.)

HB 517

Regulated Firearms - Encoded Ammunition - Tax Bans ammunition that lacks serial numbers on each projectile, establishes a registration system (so anyone buying ammo can come under suspicion of police and be investigated) and taxes ammo at a rate of 5 cents per round.

HB 877

Possession of Regulated Firearm by a Person Under 21 Years - Penalty Establishes penalties for a minor's possession of a regulated firearm. (Also filed as SB 299)

SB 42

Temporary Protective Orders - Surrender of Firearms Allows a judge to order someone's guns to be confiscated “ex parte”, that is, without a day in court. (Also under HB 640)

SB 558

Criminal Procedure - No Good Time for Gun Crime Another penalties bill that demagogues firearms rather than penalizes a base crime. (Also filed as HB 964)

SB 244

Use of Firearm in the Commission of a Crime of Violence or a Felony Demagogues guns, teaching the public to focus on a tool and not a crime. This penalty bill is bad policy and bad politics (Also filed under HB 1474)

SB 585

Public Safety - Regulated Firearms - Reporting Lost or Stolen Criminalizes your failure to report a lost or stolen gun, and is intended to let police investigate a victim rather than a thief, to which this law would not apply. A form of gun registration and another chilling effect on ownership. (Also filed under HB 880)

SB 586

Restrictions on Possession of Firearms - … Protective Order Respondent Inappropriately expands ways a person can become permanently barred from owning a firearm, without ever having been charged of a crime. This measure also removes a judge's discretion in handling domestic law. (Also filed as HB 849)

HB 849

Restrictions on Possession of Firearms - … Protective Order Respondent
Same bill as filed under SB 586 above

HB 880

Public Safety - Regulated Firearms - Reporting Lost or Stolen Same bill as under SB 585 above

HB 964

Criminal Procedure - No Good Time for Gun Crime Another penalties bill that demagogues firearms rather than penalizes a base crime. (Also filed as SB 558)

HB 1378

Possession and Sale of Ammunition for Regulated Firearms - Penalties Bans possession of ammo intended for regulated firearms (like handguns) by anyone who is not approved by state police. To possess ammo, you must apply for permission. Violation is punished by 2 yrs in jail

HB 1448

Family Law - Final Protective Orders - Surrender of Firearms By removing judge discretion, mandates permanent confiscation of firearms from anyone who is the subject of a protective order, even if never charged with a crime. Also needlessly duplicates federal law into state law.

HB 1474

Criminal Law - Use of Firearm in the Commission of a Crime of Violence or a Felony Same bill as filed SB 244 above

SB 851

Applications for Dealer's License - Record Keeping and Reporting Requirements Restricts who can have a dealer's license in the state, and expands record keeping obligations.
